PRIVACY POLICY

1.     This promotion is operated and administered by Carlsberg Marston’s Brewing Company Limited (company number 00078439) and the Wholesaler* (the Promoter). Any personal data that you provide when participating in this promotion will be held by the Promoter and the Wholesaler used for the purposes of administering the promotion, selecting the winner and fulfilling and delivering the prize in accordance with the terms and conditions relating to the promotion below (Terms and Conditions).

2.     The Terms and Conditions are the legal basis for processing your personal data. If you do not provide your personal data, your entry cannot be processed, you cannot be notified if you have won a prize and your prize cannot be fulfilled.

3.     If you win a prize, then the Promoter and/or the Wholesaler will make your name and county available, as a winner, on the Promoter's website and/or to people requesting that information in accordance with the Terms and Conditions, in line with the Promoter's responsibilities under the UK Code of Non-broadcast Advertising and Direct & Promotional Marketing. If you do not want your name made available, please inform us using the contact details in paragraph 7 (but please note the Promoter and/or the Wholesaler may still share this information with the Advertising Standards Authority if required to do so).

4.     If you are not successful in winning a prize, the Promoter will delete the personal data you have shared when participating in this promotion promptly after the prize has been awarded. If you are successful, then your personal data will not be kept for any longer than it needs to, either to comply with the law or for the Promoter and/or the Wholesaler to fulfil their obligations to you and other third parties. The Promoter and/or the Wholesaler will however continue to process any personal data they already hold about you in connection with any existing contract between you and the Promoter and/or the Wholesaler for the supply of goods. Such personal data will be processed in accordance with the relevant Privacy Notification in paragraph 7 below.

5.     Your personal data will not be shared with any third party other than those who are engaged by the Promoter to administer the competition and fulfil the prize (if any). Your personal data may be sent to countries outside of the European Economic Area where any such third party’s processing equipment is located in another country, but any such transfer will happen in accordance with applicable law.

6.     Entrants have various rights regarding their personal data which the Promoter holds about them:

a.       a right to request a copy of that data; 

b.       a right to require that the Promoter erases your data (but note that this will automatically remove your entry from the promotion and, if you are a winner, will mean that you cannot receive or take up a prize);

c.       a right to amend your data; and

d.       the right to ask us to port (transfer) your data directly to you or another organisation.

TERMS AND CONDITIONS

These Terms and Conditions apply to the "Wholesale Trade Incentive” promotion.  Please read these Terms and Conditions carefully as you will be legally bound by them from the time that you enter.

If there is a conflict in these Terms and Conditions with any other terms whatsoever attached to any other advertising material in respect of this promotion, these conditions will take precedence.

For the purpose of these Terms and Conditions, any reference to “Wholesaler” shall mean the specific wholesaler store or location where you saw this promotion. Each wholesaler operates independently, and the terms may apply differently depending on the wholesaler involved.

By engaging with a particular Wholesaler, you agree to the terms and conditions that apply specifically to that Wholesaler in addition to these general Terms and Conditions.

Eligibility

1.          This incentive promotion is open to all on-trade retailers (Entrants) trading in England and Wales holding an active customer trade account with the Wholesaler.

2.          The Promoter may remove entries and forfeit applicable prizes where an Entrant is not permitted to participate in the promotion. The Promoter reserves the right to verify the eligibility of Entrants and may require such information as it considers reasonably necessary for this purpose. A prize may be withheld until the Promoter is satisfied with the verification.

How to Enter

3.          This promotion starts at 00:01 on 1^st November 2025 and ends at 23:59 on 31^st December 2025  (Closing Date).

4.          To qualify for entry into this promotion, Entrants must prior to the Closing Date:

1. have submitted a Request for Work to install at least one Qualifying Product (as defined below) in draught format at their licensed premises to their Carlsberg Marston’s Brewing Company Business Development Manager;
2. have booked a date and time for installation of the Qualifying Product(s); and
3. have placed their first order for the Qualifying Product(s) being installed.

5.          For the purposes of this promotion, Qualifying Products include any of the following Carlsberg Marston’s Brewing Company draught products:

1. 1664 Biere;
2. 1664 Biere 0.0;
3. Birrificio Angelo Poretti;
4. Brooklyn Pilsner;
5. Brooklyn Stonewall Inn IPA;
6. Carlsberg Danish Pilsner;
7. Erdinger;
8. Estrella Damm;
9. Hobgoblin Original IPA;
10. Hobgoblin Session IPA;
11. Somersby Apple;
12. Somersby Blackberry;
13. Wainwright Amber; and
14. Wainwright Gold.

6.          Entrants who have complied with paragraphs 4-5 above by the Closing Date will be automatically entered into the Prize Draw (as defined below). The Promoter accepts no responsibility for entries or orders that are delayed, corrupted or not completed or received by the Closing Date for any reason. Proof of orders being submitted shall not be deemed to be proof of receipt of an entry.

7.          There is a maximum of one entry per Entrant for the duration of the promotion.

8.          Any instructions provided at the point of entry form part of these Terms and Conditions. In the event of a conflict, these Terms and Conditions take precedence.

9.          Entries not complying with these Terms and Conditions will be invalid.

Prize

10.        All Entrants who have complied with the entry requirements set out at paragraphs 4-5 above will be entered into a random prize draw (Prize Draw) to win customer account credit in the sum of £1,000, redeemable against Carlsberg Marston’s Brewing Company Products (as defined below) only, which will be credited to the winner’s customer trade account with the Wholesaler.

11.        The prize will be credited automatically to the winner’s customer account held with the Wholesaler within 28 days of the Closing Date. Use of the prize may be subject to restrictions in accordance with the Wholesaler’s terms of service. The winner is encouraged to check with the Wholesaler if unsure of the terms applicable to their customer trade account.

12.        The prize may be redeemed against any product which is owned by the Promoter or any of its affiliates, or which the Promoter or any of its affiliates is exclusively licensed to distribute which are stocked and sold by the Wholesaler (Carlsberg Marston’s Brewing Company’s Products). Carlsberg Marston’s Brewing Company Products are subject to availability from the Wholesaler and include any of the following products:

13.        The Promoter reserves the right to substitute an alternative prize of at least equal value if circumstances make this necessary.

14.        The prize is non-transferable and no alternative will be offered (save in the event that paragraph 13 applies). It is the responsibility of the winner to ensure that their price can be used by them.

Winner Selection and Notification

15.        All valid entries received by the Closing Date will be entered into the Prize Draw, which will take place within seven days of the Closing Date.

16.       The winner will be the first entry drawn at random from all valid entries by an independent computer process that produces verifiably random results. The winner will be contacted by the Wholesaler no later than 7^th January 2026 using the contact details held by the Wholesaler which are registered under the winner’s customer trading account.

17.        The Prize will be forfeited and a replacement winner drawn at the Promoter’s sole discretion, in the following events:

1. the prize is declined, or the winner cannot take up their prize;

2. the winner is disqualified under the terms and conditions of this promotion;

3. the prize cannot be fulfilled due to the winner’s customer trade account with the Wholesaler being closed, suspended or otherwise unavailable or inaccessible and such unavailability or inaccessibility is not remedied by the winner within a reasonable time (determined at the sole discretion of the Promoter) of notification that they have won.

Neither the Promoter nor the Wholesaler will be responsible for any inability of the winner to take up their prize. These Terms and Conditions will apply to any replacement winner.

General

18.        It is the responsibility of the Entrant to ensure that its contact details registered to its Wholesaler customer trade account are correct and complete. If an Entrant wishes to amend its contact details or wishes to withdraw from or not participate in the promotion, it should contact MAISON MAURICE.

19.        To obtain the name and county of the winning Entrant, please contact MAISON MAURICE within three months of the Closing Date.

20.        The Promoter reserves the right to suspend, cancel or amend this promotion and / or revise these Terms and Conditions at any time without giving prior notice and, by continuing to take part in the promotion subsequent to any revision, Entrants shall be deemed to have agreed to the amended terms.

21.        The Promoter may disqualify entries deemed to be non-compliant with these Terms and Conditions or if it has any reason to believe that efforts have been made to distort the competitive process or spirit of the promotion. The Promoter’s decision as to any aspect of this promotion is final. No correspondence will be entered into.

22.        By entering this promotion, each Entrant hereby warrants that all information submitted about them is true, current and complete.

23.        Entry into this promotion is deemed acceptance of these Terms and Conditions.

24.        If any provision of these Terms and Conditions is held invalid, such invalidity shall not affect the enforceability of any other provisions not held to be invalid.

25.        This promotion and all issues arising out of it shall be governed in accordance with English law and is subject to the exclusive jurisdiction of the English courts.
